MARK IT’S THE FIRST BILL PASSED : IN THE SENATE, OR EITHER CHAMBER FOR THAT MATTER, AND ADVOCATES SAY IT WILL GIVE VICTIMS A VOICE. >>THERE BEING 34 YAYS AND ONE NAY, SENATE BILL 3 IS PASSED. MARK: SENATE BILL 3, KNOWN AS MARSY’S LAW, WOULD CREATE A VICTIM’S BILL OF RIGHTS IN KENTUCKY. IT WOULD GUARANTEE THE RIGHT TO SPEAK WITH THE PROSECUTOR ABOUT THE CASE, THE RIGHT TO HAVE THE VICTIM’S SAFETY CONSIDERED WHEN A JUDGE SAID SALE, AND THE RIGHT TO RESTITUTION, AMONG OTHER THINGS. HOURS BEFORE THE SENATE CELEBRATED ITS PASSAGE, A COMMITTEE HEARD FROM SOMEONE WHO SAYS SHE COULD HAVE USED THOSE RIGHTS YEARS AGO.>>THEY ROBBED HIM AND BEAT HIM EXTENSIVELY IN THE HEAD WITH A BASEBALL BAT. MARK WHILE MELISSA BUCHANAN WAS : GRIEVING THE LIFE OF HER BROTHER SHE WAS STRUGGLING TO , FOLLOW THE CRIMINAL CASES OF HIS ATTACKERS.>>VICTIMS ARE JUST REGULAR PEOPLE. THE JUSTICE SYSTEM IS MADE UP OF LAWYERS, JUDGES AND LAW ENFORCEMENT AND FULL OF COMPLICATED PROCEDURES AND LEGAL JARGON. IT’S VERY INTIMIDATING. MARK ACLU ATTORNEY HEATHER : GATNAREK AGREES THE PROCESS CAN BE FRUSTRATING FOR VICTIMS BUT HAS CONCERNS ABOUT THE BILL. ,>>EXPANDING SERVICES FOR THOSE INDIVIDUALS TAKES A REAL INVESTMENT. THAT’S NOT WHAT SENATE BILL 3 OR 30, KNOWN AS MARSY’S LAW, DOES. WHAT IT WILL DO IS CONFUSE AND BURDEN KENTUCKY’S JUSTICE SYSTEM. MARK: THE BILL’S SPONSOR, WHITNEY WESTERFIELD, IS A FORMER PROSECUTOR AND SAYS IT’S WORTH EDUCATING HIS FORMER COLLEAGUES HOW TO BETTER SUPPORT VICTIMS. >>RIGHT NOW, THE VICTIMS ARE NOT ON AN EQUAL FOOTING WITH THE ACCUSED. I BELIEVE THEY SHOULD BE. THIS IMBALANCE MEANS THE VICTIM’S RIGHTS ARE OFTEN OVERLOOKED, AND WHEN THIS HAPPENS IT MAKES THE VICTIMS FEEL LIKE THEY ARE STANDING OUTSIDE THE PROCESS, OUTSIDE THE COURTROOM. >>THE BILL GOES TO THE HOUSE NEXT AND IF APPROVED THERE, IT WILL GO TO VOTER’S IN NOVEMBER’S ELECTION.

    Dont give a jidge more powe than the constitution allows. Every victims rights are determined by the judges handiling of the case. This amendment takes away defedants constitutional rights of fair trial

    Congrats Kentucky now we need Georgia to pass marsys law and then we will be happy because the victims wouldn't have to look over their shoulders all the time
