The Muslim Women (Protection of Rights on Marriage) Bill 2019, is the first legislation to be tabled in Parliament by Modi’s new govt. Seeking to justify the need to bring in the legislation, Prasad said there were 543 cases of triple talaq (instant divorce) reported in the country. After the Supreme Court judgement banning triple talaq practise, Prasad said more than 200 cases were reported Under instant triple talaq, a Muslim man can divorce his wife by uttering talaq three times in one go, and it has detroyed many women’s lives the the past few years. This is the same bill, that many people may remember as the bill that the secular congress party said that will remove if they came to power. But anyway people remember what happened in May The provisions of the bill wereAll declarations of instant triple talaq, including in written or electronic form, will be void (i.e. not enforceable in law) and illegal. Instant triple talaq remains a cognizable offence with a maximum of three years imprisonment and a fine. The amount of any fine is at the discretion of the magistrate hearing the case The offence will be cognizable only if information relating to the offence is given by the wife or one of her blood relatives. The offence is non-bailable. However, there is a provision that the magistrate hearing the case may grant bail to the accused. The bail may be granted only after hearing the wife and if the magistrate is satisfied that there exist reasonable grounds for granting bail. So as expected there were some opposition to the bill and one of the big oppositions to the bill came from the beloved of liberals, the paragon of secularism, Hyderabad MP and All India Majlis-e-Ittehadul Muslimeen chief Asaduddin Owaisi Those opposing the Bill have argued that if instant triple talaq does not result in divorce in the wake of the Supreme Court order, how a Muslim man would be forced to provide subsistence to the woman, who is still his wife legally.The husband will be three years in jail then who is going to pay for the maintenance? I think there are some good questions to be asked and I don’t think the bill is perfect and just like the dowry bill, this bill can also be misused But that’s not enough, the point of being aliberal is that you MUST go over the top. He said, “Through this, I would like to ask the government that they have all the love for Muslim women. Why don’t they have the same sentiment for Hindu women of Kerala? Why are you against Sabarimala?” This is a nice strategy: act as if Sabarimala and Triple talaq is the same thing: If you have so much care for Hindu women, then lets compare the two situations First and foremost, the lives of women are not affected if they are not entering into a single particular Temple. However, if a woman is given Triple Talaq by her husband, it throws her entire life into chaos. Secondly, the traditions at Sabarimala Temple are not universal in nature. It is not even a universal aspect of every Temple of Bhagavan Ayyapa. It is specific to that particular Temple alone. Therefore, if a woman wishes to worship Him, she can still go to other Temples dedicated to Him The Muslim custom is applicable to every single woman of the community and there is no escape from it, it hangs like a sword around their neck at every moment of their life. At any time, her life can be destroyed anywhere in the country and they have no help the Sabarimala traditions do not have the capacity to oppress women unlike the custom of Triple Talaq As a consequence of Triple Talaq, many women are then subjected to the extremely evil tradition of Nikah Halala Nikah-halala is a practice of a divorced woman having to consummate the marriage with another man and then getting a divorce from him before remarrying her previous husband.
