members we now move to part 5 and this is debate on clauses 183 to 237 and schedules 7828 and the question is that part 5 stand part I call Dennis O’Rourke mr. chairman New Zealand fest will be voting against this part as well and I’d like to speak in particular about section Clause 184 which would amend section 4 of the exclusive economic zone and continental shelf environmental effects Act 2012 and what is objection Allah bout this is the exclusions because it defines dumping in dumping means and a quote firstly any deliberate disposal into the sea of waste or other matter from ships aircraft and structures at sea and then goes on in two three and four in relation to deliberate disposal into the sea of ships storage of waste and abandonment or toppling of structures but it is the next subsection B which creates the difficulty because having quite properly prohibited dumping of the things that I’ve just mentioned it in list and incredible list of exclusions which are so broad as to virtually nullify the the definition of dumping which in n 1 a and I refer in particular to be to the new definition of dumping be one and this is what it says now listen carefully because it takes a lot of listening to mr. chairman 1 the disposal into the sea of waste or other metal incidental to or derived from the normal operation of ships aircraft and structures at sea and their equipment other than waste or other matter transported by or two ships aircraft and straight is it etsy operating for the purpose of disposal of such matter or derived from the treatment of such waste or such other metal on ships aircraft in structures did you get that mr. chairman did you get that that’s really really clear that you don’t drink anything to me I’m I’m impartial on these matters you direct it to the minister or to other members I will I’ll do exactly garel Minister did you get that he’s going to notice here is he I bow sure he would but he’d be one of the few because there is such convoluted nonsense that is such convoluted nonsense as to be virtually unintelligible and it is so broad so broad in its interpretation that there is virtually no point in having a definition of dumping in one a at all but but what it really means is that we have a very very permissive regime here as to what can actually be dumped or disposed of at sea far far too permissive and it actually amounts to a permission to dump waste etsy or on our exclusive economic zone or continental shelf of a whole range of materials which ought not to be and there is no reason for them to be disposed of it see in that way but it goes on mr. chairman and goes on in B 2 by saying this it prohibits dumping but it does not include placement of matter this isn’t to placement of metaphor a purpose other than the mere disposal of the matter but only if the placement is not contrary to the aims of the 1996 protocol to the london convention or three abandonment in the sea of meta for example cables pipelines in marine research devices placed for a purpose other than the mere disposal of it so we’re talking about here about deliberate x because of abandonment as a deliberate act it’s not just a loss of that those materials it’s a deliberate act to get rid of the etsy of those things which I mentioned and somehow the this the words the words other than mere disposal are supposed to be some kind of qualification well I don’t think they are I think this regime is far far too permissive and it is not something which we should be permitting as a parliament so I can drop the Honourable member the time has come for me to leave the cheer for the dinner break members us debate is interrupted and I shall resume the chair at seven-thirty
