PROCEED, PLEASE.>>THANK YOU, MR. SPEAKER. THIS AMENDMENT WOULD PROVIDE FOR A CONSTITUTIONAL AMENDMENT REQUIRING VOTER REFERENDUM FOR ANY EXTENSION OF TOLLS TO PAST PASSENGER VEHICLES. I’M HAPPY THAT THE LEDGES BEFORE US CONTAINS A REFERENDUM REQUIREMENT. MY WESTERN HAS ALWAYS BEEN THIS TO A FUTURE LEGISLATURE COALWAYS CHANGE THE LAW AND TAKE THAT REFERENDUM REMAINDER AWAY. WE’VE SEEN THE LEGISLATURE MAKE CHANGES IN THE PAST THAT WERE CONTRARY TO PROMISES THAT IT HAD MADE, AND I DON’T SPEAK TO THE MEMBERS OF — INDIVIDUAL MEMBERS OF THIS BODY. IN THE PAST THAT HAS BEEN DONE. THE LEGISLATURE HAS MADE PROMISES AND IT HASN’T KEPT THEM. THIS IS THE ONLY WAY THAT WE CAN GUARANTEE THE PEOPLE THAT A FUTURE LEGISLATURE WILL NOT BE ABLE TO ASSESS TOLLS AND THEIR PASSENGER VEHICLES ABSENT A VOTE OF THE PEOPLE THANK YOU, MR. SPEAKER.>>THANK YOU, REPRESENTATIVE. REPRESENTATIVE BLAZEJEWSKI.>>THANK YOU, MR. SPEAKER, MEMBERS OF THE HOUSE. I ALSO RISE IN OPPOSITION TO THIS AMENDMENT. I WON’T REPEAT MY ARGUMENTS ON THE REFERENDUM. I THINK THEY ALL APPLY TO THIS AMENDMENT FOR THE REASONS THAT WE STATED BEFORE SO I WILL NOT REPEAT THEM. BUT ON THE ISSUE OF PUTTING TOLLS IN OUR CONSTITUTION, I JUST SIMPLY DON’T THINK THAT IT’S APPROPRIATE IN OUR SACRED FOUNDING DOCUMENTS TO PUT THIS POLICY ISSUE IN OUR CONSTITUTION. THE WORD “TOLL” DOESN’T APPEAR. I SEARCHED IT, AND I DIDN’T SEE IT IN THERE AND I DON’T SEE ANY REB TO ADD IT IN THERE. WE’VE ADD PROTECTIONS FOR A RIGHT HAND OF FOR PASSENGER CARS. THAT’S IN THERE RIGHT NOW. AND I JUST THINK THAT IT’S AN OVERREACH TO PUT IN OUR SACRED FOUNDING DOCUMENT THIS TOLLING ISSUE. IT’S JUST NOT APPROPRIATE AND I URGE YOU TO DEFEAT THIS AMENDMENT. YOU KNOW, IF WE’RE SO SURE THAT WE’RE NOT GOING — THAT WE’LL — THAT THIS BODY, WHETHER IT’S US OR OUR GREAT-GRANDCHILDREN, IS NEVER GOING TO DO THIS AND THEY’RE GOING TO LET THE PEOPLE VOTE ON IT, THEN WHAT’S THE BIG DEAL IN JUST PUTTING IT IN THE CONSTITUTION? WOULDN’T IT HAVE BEEN VERY CONVENIENT IF WE WERE TO PUT THE LOTTERY REVENUES IN THE CONSTITUTION THAT THAT GOES TO EDUCATION? WOULDN’T IT HAVE BEEN REALLY, REALLY GOOD IF WE HAD PUT THAT 2% INCOME TAX IN THE CONSTITUTION THAT BAILED OUTS OF THE DEBT? NO. SO SOMEDAY, SOMEDAY WE’RE GOING TO BE HAVING THE SAME CONVERSATION. YOU KNOW WHAT? WE NEED MORE MONEY. I THINK WE SHOULD JUST LEGIT THAT LITTLE LINE OUT OF THERE THAT VOTER REFERENDUM AND THINGS LIKE THAT. LET’S JUST DO IT NOW. WE’LL JUST TAKE THAT PILL, WE’LL SWALLOW IT NOW, AND BY THE TIME THE NOVEMBER ELECTION COMES, THE PEOPLE WON’T EVEN REMEMBER WE DID IT, SO THANK YOU VERY MUCH.>>LEADER DESIMONE.>>THANK YOU, MR. FIRST AND FOREMOST LET ME SHUAI THAT EVERY TEN YEARS THE PEOPLE OF RHODE ISLAND VOTE AS TO WHETHER OR NOT THEY WANT TO HAVE A CONSTITUTIONAL CONVENTION, AND AT THAT CONVENTION IS THE APPROPRIATE TIME FOR THOSE CONVENTIONEERS TO DETERMINE WHAT THEY WANT TO PUT IN THE CONSTITUTION. SO I WOULD SUGGEST TO THE MEMBERS HERE THAT THIS PARTICULAR AMENDMENT IS TOTALLY UNAPPROPRIATE AT THIS TIME. BUT ALSO IN ADDITION, I WANT EVERYONE TO KNOW THAT THIS SAME AMENDMENT IN THE FORM OF A BILL WAS TAKEN UP BY THE HOUSE FINANCE COMMITTEE. THEY DELIBERATED. THEY HEARD TESTIMONY ON IT. AND THEY RULED TO HOLD IT FOR FURTHER STUDY. SO WITH THAT, THE CONSTITUTION IS A SACRED DOCUMENT THAT WE ONLY AMEND AND SHOULD ONLY AMEND DURING THE CONSTITUTIONAL CONVENTION, AND, BY THE WAY, THE LAST 20 YEARS THE VOTERS OF VOTED DOWN HAVING A CONSTITUTIONAL CONVENTION. SO WITH THAT, I WOULD SUBMIT TO MY COLLEAGUES WE SHOULD VOTE THIS AMENDMENT DOWN. THANK YOU.>>REPRESENTATIVE FILIPPI.>>THANK YOU, SPEAKER. THERE’S A PROVISION IN OUR STATE CONSTITUTION THAT AUTHORIZES THE LEGISLATURE TO TAKE OFF-SITE PARKING FACILITIES — EXCUSE ME — THAT AUTHORIZES MUNICIPALITIES TO TAKE LAND FOR OFF-STREET PARKING FACILITIES. SO THERE ARE SOME THINGS IN OUR CONSTITUTION WHICH I WOULD SUBMIT TO YOU ARE LESS IMPORTANT THAN PROTECTING OUR FREEDOM OF MOVEMENT. IN TERMS OF WHAT THE PEOPLE VOTE ON IN OUR KAWASAKI THEY HAVE TO APPROVE CASINOS, THEY HAVE TO APPROVE ALL DEBT. , GENERAL OBLIGATION DEBT, PARDON, AND THE PEOPLE IN INDIVIDUAL MUNICIPALITIES HAVE TO APPROVE ACTS BY THE GENERAL ASSEMBLY WHICH RELATE TO THE MUNICIPAL AFFAIRS IN OUR INDIVIDUAL CITIES AND TOWNS. LET’S BE CLEAR. IF WE AMEND OUR CONSTITUTION TO DEAL WITH OUR INDIVIDUAL RIGHTS, I AGREE IT’S A SOMBER OCCASION AND WE SHOULD HAVE A LOT OF PAUSE, OUR RIGHTS TO AN ATTORNEY, OUR RIGHTS TO PRIVACY AND DUE PROCESS. WE SHOULD BE VERY CAREFUL OPENING UP OUR CONSTITUTION TO DEAL WITH THOSE FUNDAMENTAL RIGHTS. BUT WE SHOULD MUCH MORE WILL I BE RABBLEY OPEN UP OUR CONSTITUTION AND IT RELATES TO LIMITING THE POWER OF GOVERNMENT. THAT’S WHAT THIS AMENDMENT DOES. IT RESTRICTS THE POWER OF GOVERNMENT AND EMPOWERS THE PEOPLE, AND THAT’S SOMETHING WE NEED MORE OF IN THIS STATE,.>>THIS COUNTRY, EMPOWERING THE PEOPLE AND LIMITING GOVERNMENT. AND BY DOING THAT WITH THAT AMENDMENT, WE WOULD BE PROTECTING OUR FUNDAMENTAL RIGHT TO TRAVEL, WHICH HAS BEEN RECOGNIZED BY THE UNITED STATES SUPREME COURT SINCE THE MID 1800S. WE HAVE A FUNDAMENTAL RIGHT TO FREE MOVEMENT. THIS CONSTITUTIONAL AMENDMENT PROTECTS THAT FUNDAMENTAL CONSTITUTIONAL RIGHT, AND JUSTLY LIMITS THE POWER OF GOVERNMENT, AND EMPOWERS THE PEOPLE.
